Questions clients ask us
Can a prescription medicine be advertised in Hungary?
Not to the general public. Commercial communication for a prescription-only product may be addressed only to healthcare professionals, in a prescribed form and content, and the professional material has to be consistent with the summary of product characteristics. Over-the-counter products may be advertised, but with content restrictions and a mandatory warning.
What has to be settled in a clinical trial agreement?
The parties' roles in the trial, the controller and processor positions, ownership and permitted use of the trial data and results, insurance cover and liability for damages, and publication rights. Processing health data requires its own documentation and cannot be left to the general privacy notice.
